Terms of Service

1. Acceptance of Terms

By accessing or using the WaterDuty platform ("Service"), operated by WaterDuty ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

WaterDuty provides water usage monitoring and leak detection services for single-family rental (SFR) property portfolios. The Service connects to third-party utility providers on your behalf to collect water usage data and alert you to potential leaks or anomalies.

3. Account Registration

To use the Service, you must:

  • Create an account with accurate and complete information
  • Maintain the security of your account credentials
  • Be at least 18 years old or the age of majority in your jurisdiction
  • Notify us immediately of any unauthorized use of your account

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Utility Provider Credentials

To provide our monitoring service, you authorize WaterDuty to access your utility provider accounts using the credentials you provide. You represent that you have the authority to grant this access and that your use complies with the utility provider's terms.

Your utility credentials are encrypted and stored securely as described in our Privacy Policy. We access your utility accounts solely for the purpose of retrieving water usage data on your behalf.

5. Subscription and Billing

The Service operates on a subscription basis. By subscribing, you agree to pay the applicable fees as described on our Pricing page. Key billing terms:

  • Billing is monthly, starting from your subscription date
  • Fees consist of a base subscription plus a per-meter monitoring charge
  • You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
  • We reserve the right to change pricing with 30 days' notice
  • Refunds are available within 30 days of initial purchase

6. Free Trial

We may offer a free trial period. During the trial, you have full access to the Service. If you do not cancel before the trial ends, your subscription will begin and you will be charged the applicable fees. No credit card is required to start a trial.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the Service or its infrastructure
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Resell or redistribute the Service without our written consent
  • Provide false or misleading information in your account

8. Data and Privacy

Your use of the Service is subject to our Privacy Policy. By using the Service, you consent to the collection and use of your data as described therein. You retain ownership of the data you provide; we claim no ownership over your property information or usage data.

9. Service Availability and Accuracy

We strive to provide reliable and accurate monitoring, but the Service is provided "as is." We do not guarantee:

  • Uninterrupted or error-free operation of the Service
  • That all leaks or anomalies will be detected
  • The accuracy or completeness of data from third-party utility providers
  • Specific response times for alerts or notifications

Utility provider outages, data delays, or API changes may affect the availability and accuracy of our monitoring.

10. Limitation of Liability

To the maximum extent permitted by law, WaterDuty shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, property damage, or water damage, arising from your use of the Service.

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

WaterDuty is a monitoring and alerting tool—not a guarantee against water damage. You remain responsible for maintaining your properties and responding to alerts in a timely manner.

11. Indemnification

You agree to indemnify and hold harmless WaterDuty, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

12. Termination

Either party may terminate this agreement at any time. Upon termination, your access to the Service will cease. We may retain certain data as required by law or for legitimate business purposes, but will delete your utility credentials promptly upon account closure.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to conflict of law principles.
